POWERSWEEP PRODUCT WARRANTY TERMS

POWERSWEEP WARRANTY

Powersweep warrants that the goods you purchase are free from defects in workmanship and materials under normal use for the periods detailed below from the purchase date. Under this warranty, Powersweep will repair or replace at its factory, or through an authorised service provider, parts of the equipment that fail under normal use. This warranty is limited to defects in the materials or workmanship in the product and does not cover wear and tear or consumable wear items, as described under “Exclusions” below.

​This warranty is applicable only to the original purchaser. Powersweep is not responsible for costs or repairs performed by persons other than those specifically authorised by Powersweep. This warranty does not apply to damage from transportation, alterations by unauthorised persons, misuse or abuse of the equipment, use of non-compatible chemicals, or damage to property, or loss of income due to malfunction of the Equipment.

​Powersweep warrants that, subject to the exclusions and limitations below, the product will be free from defects in material and workmanship for the duration of the warranty period detailed below, from the date of purchase.

Note:    Ex Demonstration and Superseded machines will be covered for the warranty period stipulated at time of sale

​Warranty Claim Process:
(1)      If a fault covered by the warranty occurs, the purchaser must contact Powersweep once the fault is noted on 02-96034455 or by emailing service@powersweep.com.au and provide detail of the fault, if the warranty claim is deemed to be valid or in need of assessment to verify validity, Powersweep will provide you with instruction to have the product assessed for warranty.

(2)      Any warranty claim must be accompanied by proof of purchase and details of the alleged defect

(3)     If the product is to be returned to us for warranty assessment, our address is: Factory 4, No 1 Reaghs Farm Rd Minto NSW, in some instances we may elect to have the warranty assessment carried out at alternate locations and reserve the right to advise on a case-to-case basis, subject to the location of the product.  

(4)     we are entitled to charge and recover from you all reasonable costs incurred by our firm in connection with transport and assessment of each warranty claim if we determine that the warranty claim is invalid through any of the examples below, or other finding that voids the warranty or determines ineligibility of warranty cover.

Exclusions:
The warranty does not cover or apply to:

(a)    Product that has been modified by You in any instance where the fault is a direct result of the modification.

(b)    the costs incurred by Powersweep in travel and labour to provide on-site operator training

(c)    the costs incurred in travel and labour for technicians to attend sites to carry out any adjustment to brushware or squeegees on the Product, as both are operator        responsibilities and should be done by the operator to suit the specific site, operator instruction on this is provided within the Products operator manual

(d)    any fault that has occurred through the Product being used for a purpose of which it was not designed for

(e)    the Product has been subject to abnormal conditions, examples of, but not limited to temperature, water, humidity, corrosive environments, pressure, stress or similar

(f)     the purchaser has used or fitted non-genuine parts and accessories and in doing so, created the fault

(g)    the Product fault has arisen due to abuse, misuse, neglect, collision, or accident

(h)    the Product defect has arisen due to the purchaser’s failure to properly maintain or use the Product, in accordance to the manufacturers or Powersweeps operational instruction or guidance

(i)     the damage or failure of the Product resulted from low or high voltage, or the use of an incorrect battery charger

(j)     the damage has been caused by impurities in the water supply to the product and/or debris contaminating the water pump, motor or steam vacuum boiler.

(k)    the damage has been caused by the use of corrosive chemicals

(l)     consumables that are generally replaced during routine maintenance services, such as but not limited to: brushware, pad holders, squeegee blades, filters and spark plugs

(m)   wear and tear, note in the case of used machines, wear and tear also includes what would be reasonably expected based on the hours accrued and or age of the product.

CONSUMER WARRANTY:

The following statements only apply to a consumer sale of goods or services as defined in the Australian Consumer Law. In this statement, 'Our' means 'Powersweep' and 'you' means 'original purchaser:

  1. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.

  2. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

To the extent permitted by law, all other warranties whether implied or otherwise, not set out in these warranty terms and conditions are excluded and Powersweep is not liable in contract, tort (including, without limitation, negligence or breach of statutory duty) or otherwise to compensate you for:

  • any increased costs or expenses;

  • any loss of profit, revenue, business, contracts or anticipated savings;

  • any loss or expense resulting from a claim by a third party; or

  • any special, indirect or consequential loss or damage of any nature whatsoever caused by Powersweep’s failure in complying with its obligations

​ The benefits in the Powersweep warranty provisions are in addition to any rights or remedies that may apply under Australian law
